SECTION 3 – LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  2. User Responsibility: You accept full responsibility for any harm, damage, or loss arising from the use, misuse, or inability to use our products.
  3. No Liability for Harm: Rogue Racing Designs shall not be held liable for any injury, property damage, or incidental or consequential losses, whether caused by product failure, negligence, or misuse.

SECTION 4 – RETURN POLICY

Return Policy and Product Quality Assurance

  • Defects and Damage: If your product is found to have a manufacturing defect or arrives in a damaged condition, you may request a replacement or repair within 14 calendar days of receiving the product.
  • Eligibility Requirements:

    2. Provide clear photographic evidence of the defect or damage.
    3. Return the product in its original condition, packaging, and configuration.

Limitations:

  • Requests made after the 14-day period will not be eligible for return, repair, or replacement.
  • Damage caused by improper use, unauthorized modifications, or failure to follow installation guidelines will void eligibility for returns or replacements.

Once the 14-day period has passed, Rogue Racing Designs disclaims any liability for defects or damages, and the product is considered accepted by the customer in its delivered condition.

SECTION 5 – SAFETY AND ASSUMPTION OF RISK

By using our products, you acknowledge and agree that:

  1. Risk of Use: Simulator racing wheels, frames, and related accessories are subject to stress, wear, and external forces during use. You are solely responsible for evaluating whether our products are suitable for your specific application and for ensuring proper installation and maintenance.
  2. No Guarantee of Safety: We disclaim any liability for injuries, damages, or accidents that occur due to failure of the product under normal or abnormal use.
  3. User-initiated Modifications: Any modifications or alterations made by the user void any implied or expressed warranty.

SECTION 6 – MODIFICATIONS TO SERVICES AND PRICES

We reserve the right to modify, change, or update our pricing, product availability, or services at any time without prior notice. Prices are subject to change at the sole discretion of Rogue Racing Designs, and we will not be held liable for any discrepancies arising from these changes. Any purchases made prior to a price change are not eligible for refunds or adjustments unless otherwise stated.

SECTION 7 – THIRD-PARTY TOOLS AND SERVICES

Our website integrates tools provided by third-party platforms, including but not limited to Shopify for e-commerce functionality and Zakeke for product customization. While we take full responsibility for the quality and functionality of our products, we are not liable for any errors, delays, or malfunctions caused by third-party platforms that affect the use of our website or customization process.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, United States. Any disputes shall be resolved exclusively through the courts located in Houston, Texas.
